Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") governs your access to and use of CampaignLark and all related websites, applications, APIs, and services provided by Maileroo Group Pty Ltd ("CampaignLark", "we", "us", or "our"). By using the Service, you agree to comply with this AUP, our Terms of Service, and all applicable laws and regulations.

2. Permission-Based Use Only

CampaignLark is a permission-based email marketing platform. You may only use the Service to send messages to recipients who have provided valid, informed, and verifiable consent to receive them, or where you otherwise have a lawful basis to send under applicable law. You are responsible for maintaining proof of consent and demonstrating compliance if requested.

  • No Unsolicited Email: Sending unsolicited email is strictly prohibited. Every message must be sent only to recipients who have given clear, verifiable consent.
  • No Third-Party Lists: You are expressly forbidden from uploading, importing, purchasing, scraping, renting, harvesting, or appending any third-party contact list. All recipients must have been collected through your own lawful channels.
  • No Cold Outreach: Cold emailing, unsolicited sales outreach, outbound prospecting, and mass messaging to recipients who have not explicitly opted in are strictly prohibited on CampaignLark.
  • Accurate Sender Information: You are required to use accurate, verifiable sender information, honest subject lines, and a fully functional unsubscribe mechanism in every message. Failure to comply may result in immediate account action.
  • Bounce and Complaint Thresholds: You must maintain a bounce rate below 5% and a complaint rate below 0.1% at all times. Exceeding these thresholds may result in sending restrictions, account review, or suspension.

3. Prohibited Activities

You may not use the Service for, in connection with, or to facilitate any of the following:

  • Spam and Unsolicited Messaging: sending bulk, commercial, or automated messages without consent, including email blasts to non-opt-in recipients.
  • Cold Emailing: lead generation, sales outreach, or prospecting campaigns sent to recipients who have not expressly requested or consented to receive your emails.
  • Phishing, Fraud, and Scams: impersonation, credential harvesting, deceptive offers, fake invoices, advance-fee schemes, business email compromise, or any attempt to mislead recipients.
  • Illegal or Harmful Conduct: promoting, facilitating, or engaging in unlawful, abusive, exploitative, or harmful activity.
  • Malware and Malicious Content: distributing viruses, trojans, worms, spyware, ransomware, malicious scripts, or links to harmful content.
  • Identity Misrepresentation: falsifying sender identity, headers, domains, reply addresses, landing pages, or message origin.
  • Intellectual Property Infringement: violating copyrights, trademarks, patents, trade secrets, or other proprietary rights.
  • Objectionable Content: distributing content that is defamatory, harassing, threatening, abusive, hateful, or otherwise unlawful.
  • Unauthorized Access and Security Abuse: attempting to gain unauthorized access to systems, accounts, networks, or data, including hacking, credential stuffing, scraping protected resources, or evading access controls.
  • Platform or Network Abuse: actions that damage, disrupt, overburden, degrade, or interfere with CampaignLark, our infrastructure, other customers, mailbox providers, or third-party networks.
  • List Evasion or Suppression Evasion: attempting to bypass unsubscribes, suppressions, bounce handling, complaint protections, account reviews, sending limits, or trust and safety controls.

4. Sensitive Categories Requiring Prior Approval

Certain industries, use cases, or content categories carry elevated compliance, fraud, reputation, or deliverability risk. These categories are not automatically permitted on CampaignLark and may only be used with our prior written approval. We may approve, deny, limit, or later revoke access at our sole discretion.

Sensitive categories may include, but are not limited to:

  • Financial Services: Financial services, lending, debt collection, credit repair, and investment offers
  • Cryptocurrency: Cryptocurrency, token sales, trading alerts, forex, and high-risk financial promotions
  • Gambling: Gambling, betting, gaming-for-money, and sweepstakes
  • Adult Content: Adult or sexually explicit content or services
  • Health and Pharmaceuticals: Health, wellness, supplements, pharmaceuticals, medical claims, and treatment-related messaging
  • Political Messaging: Political campaigning, lobbying, advocacy, and public affairs messaging
  • Legal Services: Legal services in regulated or high-risk practice areas
  • Affiliate and Performance Marketing: Affiliate marketing, lead brokering, list brokering, and performance marketing offers
  • MLM and Income Schemes: Multi-level marketing, get-rich-quick, work-from-home, and similar income opportunity promotions
  • Other High-Risk Use Cases: Any content or use case we reasonably determine presents elevated abuse, compliance, or deliverability risk

Approval, if granted, may be subject to additional screening, domain verification, sample review, consent documentation, lower sending limits, dedicated infrastructure requirements, or ongoing monitoring.

5. Compliance Responsibilities

You are solely responsible for your content, recipient data, sending practices, and legal compliance. This includes compliance with anti-spam, privacy, consumer protection, and electronic communications laws applicable to your recipients and jurisdiction, including consent, identification, unsubscribe, and record-keeping requirements.

6. Account and Data Security

You must maintain the security of your account credentials, API keys, and connected systems. You must promptly notify us of any unauthorized access, compromise, or suspected abuse. You are responsible for all activity conducted through your account, whether authorized by you or not.

7. Monitoring and Enforcement

To protect our platform, customers, and recipient networks, CampaignLark may monitor for abuse, investigate complaints, request supporting information, and take enforcement action where necessary. Enforcement may include campaign review, content removal, list rejection, feature restrictions, temporary suspension, permanent termination, or referral to relevant authorities.

We may act immediately where we believe there is a risk of spam, phishing, fraud, security harm, legal exposure, or reputational damage, including to mailbox providers, recipients, or our infrastructure.

8. Reporting Violations

Suspected violations of this AUP should be reported to CampaignLark immediately. We review abuse reports seriously and may request additional details, evidence, or compliance records as part of our investigation.

9. Changes to this Policy

We may update this Acceptable Use Policy from time to time. Updated versions become effective when posted on our website. Continued use of the Service after an update constitutes acceptance of the revised AUP.
